AN ORDINANCE GRANTING 50% TAX HOLIDAY FOR THE FIRST SIX MONTHS FROM JANUARY TO JUNE 2004 TO ALL ESTABLISHMENTS AFFECTED BY THE ON-GOING CONSTRUCTIONS OF THE DON GALO – LA HUERTA BRIDGE
WHEREAS, the Don-Galo-La Huerta bridge along Quirino Avenue has been closed to vehicular traffic since Sept. 16,2003 due to the purported construction of a new bridge to replace the existing bridge;
WHEREAS, those affected business establishments continue to experience financial losses that might trigger their closure;
WHEREAS, one way this city government can show due regard and sensitivity to this sorry state and plight of the concerned business establishments is by providing the same a fifty (50%) percent tax holiday for the first six (6) months of 2004.
WHEREAS, Republic Act No. 7160 also known as the Local Government Code of 1991, provides that local government units may, through ordinances duly approved, grant exemption, incentives or relief under such terms and conditions as they may deem necessary .
NOW, THEREFORE:
BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the Sangguniang Panglungsod in session assembled, that this ordinance granting “tax holiday” of 50% percent to certain establishments affected by the construction of the Don Galo-La Huerta Bridge in the payment of their business taxes for January to June 2004 subject to certain conditions:
SECTION 1. Coverage. This ordinance shall cover all registered business establishments within the affected areas of barangays Don Galo, Tambo, La Huerta and Dan Dionisio of this city, more particularly those:
All Business establishments from the corner of Tambo Elementary School (NAIA Road) to Kabihasnan, San Dionisio unless otherwise stated by existing laws. Furthermore, this ordinance shall apply only to business tazes for the year 2004, whether paid or unpaid by business establishments covered by this ordinance.
SECTION 2. Payment. Payment of business taxes for the year 2004, shall be made in full.
SECTION 3. Refund. Those covered under this ordinance who have paid their taxes for the year 2004 before the effectivity of this ordinance shall be refunded within sixty (60) days the amount equivalent to 50% of the payment.
SECTION 4. Exclusion. The following are not eligible / qualified to apply for the tax relief provided by this ordinance:
- Those with pending or protested cases with the Treasurer’s office or the courts.
- Those whose payment are not in full.
SECTION 5. Validity. This ordinance shall be valid from date of effectivity up to and until March 31, 2005.
Section 6. Information and Publication. The government of this city as well as the concerned barangays affected by the construction of Don Galo- La Huerta bridge shall conduct an information campaign in order to attain the defined objective of this ordinance.
Section 7 Effectivity Clause. This ordinance shall take effect upon its approval.
