AN ORDINANCE REQUIRING ALL VERTICAL AND HORIZONTAL CONTRACTORS TO HIRE AT LEAST TWENTY (20%) PERCENT OF THEIR WORKFORCE FROM THE BARANGAY WHERE THEIR CONSTRUCTIONS ARE SITUATED.
WHEREAS, there is a need to promote local employment by requiring vertical and horizontal contractors and/or owners of structures being built to give priority to barangay residents.
WHEREAS, it has been observed that some vertical and horizontal contractors are hiring workers living outside the barangays where their constructions are situated.
WHEREAS, enacting an ordinance of this nature will encourage the barangay to conduct manpower training and pooling of its skilled and unskilled workers.
WHEREAS, hiring at least twenty (20%) percent of their workforce from the local barangay will be beneficial to the contractor and the barangay.
NOW, THEREFORE:
BE IT ORDAINED, AS IT IS HEREBY ORDAINED by the City Council assembled that:
SECTION 1. All vertical and horizontal contractors are mandated to hire at least twenty (20%) percent of their total workforce from the barangay where their constructions are situated.
SECTION 2. The Barangay Council is hereby mandated to conduct a pooling/listing of its skilled and unskilled workers to supply the needs of the contractors and to conduct skills training of warranted and necessary.
SECTION 3. The Barangay Council is also mandated to require all applicants for Construction Clearance to issue a Certification specially stating therein the total number of workforce that will undertake the project and copy furnished the Building Permit Office and/or Sangguniang Panlungsod’s Committee on Land Use & Zoning when Locational Clearance is necessary.
SECTION 4. The Barangay Captain or his duly authorized representative, shall conduct an ocular inspection once a month to ensure that, at least twenty (20%) percent of the workers are hired from his barangay.
Every ocular inspection that will result in the Non-Compliance of the requirement, shall constitute an offense and be properly reported by Barangay Captain to the Treasurer and/or Building Permit Office of the City for the imposition of fine as herein provided.
SECTION 5. Penalties. Contractors found violating the provisions of the ordinance shall be fined with:
First Violation - P 4,000.00
Second Violation - 5,000.00
Third Violation - Cancellation of Building and/or Construction Permit
SECTION 6. Effectivity. This ordinance shall take effect fifteen (15) days after publication in any newspaper of general circulation in the City of Paranaque.
